Climate change law is the comprehensive body of legal rules, policies, and international agreements designed to address both the causes and impacts of global warming. Rather than being a single statute, climate change law operates across multiple levels of government and across borders, creating an interconnected system of legal responsibilities. Climate change law is inherently interdisciplinary, drawing on principles from environmental law, international law, energy law, and public policy. This combination is necessary because climate change affects nearly every area of human activity—from transportation and electricity generation to agriculture and construction. The field pursues three main objectives: Mitigation: reducing greenhouse-gas emissions to slow the pace of warming Adaptation: helping communities adjust to climate impacts that are already occurring Energy transition: supporting the shift away from fossil fuels toward clean, renewable energy sources By establishing this legal framework, climate change law provides guidance to governments, businesses, and individual actors about their responsibilities in responding to climate change. Without such frameworks, the incentives to reduce emissions would be weak, because the costs of emissions fall on society broadly, while the profits from emission-producing activities flow to individual companies. International Climate Agreements The Foundational Treaty: The UNFCCC The starting point for modern international climate law is the United Nations Framework Convention on Climate Change (UNFCCC), adopted in 1992 at the Rio Earth Summit. This treaty represented the first time nations formally agreed that climate change was a global problem requiring collective action. The UNFCCC established the principle that nations should work together to "stabilize greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system." How Nations Meet and Negotiate: The COP Process The UNFCCC created an ongoing mechanism for countries to refine and deepen their commitments. Every year, the parties to the treaty meet at the Conference of the Parties (COP). At these meetings, nations negotiate new commitments, review progress on existing ones, and adapt strategies based on evolving climate science. COP meetings have become major international events—the Paris meeting in 2015 was attended by representatives from nearly 200 countries. The Paris Agreement: A Shift in Approach The Paris Agreement, adopted at COP21 in 2015, represents a fundamental shift in how the world approaches climate law. Rather than imposing top-down targets on nations, the Paris Agreement adopts a "bottom-up" approach where each country determines its own ambition. Under the Paris Agreement, every nation must submit a nationally determined contribution (NDC)—a document outlining that country's emissions-reduction targets and the policies it will use to achieve them. This allows countries with different economic conditions, energy systems, and capacities to set realistic targets. One country might commit to reducing emissions 40% by 2030, while another commits to 20%, depending on its circumstances. However, the Paris Agreement creates accountability not through strict penalties (which would be difficult to enforce internationally), but through a system of transparency and peer pressure. Countries must regularly report on their progress, and their reports are reviewed by other nations and the international community. This public transparency creates political incentives for countries to achieve their stated goals. Domestic Climate Legislation Once nations agreed to international climate goals, they needed to implement these commitments through domestic law. Two examples illustrate this: In the United States, the Clean Air Act provides the legal foundation for climate regulation. While originally written to address air pollution, the Act has been interpreted to authorize the U.S. Environmental Protection Agency to regulate carbon dioxide and other greenhouse gases as air pollutants. In the European Union, the "Fit for 55" package of legislation establishes binding requirements for EU member states to reduce net emissions by at least 55% by 2030 (compared to 1990 levels). This is a more aggressive timeline than many other major economies. Main Legal Tools for Climate Mitigation Governments use several distinct legal tools to reduce emissions. Understanding these tools is essential because they appear throughout climate legislation worldwide. Carbon Pricing Carbon pricing puts a monetary cost on greenhouse-gas emissions, creating a financial incentive to reduce them. There are two main approaches: Carbon tax: A government directly taxes emissions at a set price per ton of carbon dioxide equivalent. A $50 per ton carbon tax, for example, would make emitting one ton of CO₂ cost the emitter $50. Cap-and-trade system: Rather than setting a price, the government sets a quantity limit (the "cap") on total emissions. It then issues permits equal to this cap and allows companies to buy and sell them. If a company reduces emissions more than required, it can sell its extra permits to other companies. This creates an indirect price for carbon through market trading. Both approaches create economic incentives for emissions reductions, but they differ in predictability: a carbon tax creates price certainty but quantity uncertainty, while cap-and-trade creates quantity certainty but price uncertainty. Regulatory Standards Regulatory standards directly mandate emissions reductions or energy-efficiency requirements through specific rules. Key examples include: Fuel-efficiency rules: Require that new vehicles sold meet minimum fuel-efficiency standards (often measured in miles per gallon). A rule might require that the average new car sold in 2030 must achieve at least 50 miles per gallon. Emissions limits for power plants: Establish the maximum amount of pollution (including carbon) that electricity-generating facilities can emit. This is measured in pounds or tons per unit of energy produced. Building-energy codes: Prescribe energy-efficiency requirements for new construction and major renovations, such as requiring certain types of insulation, windows, or heating systems. Renewable-portfolio standards: Require utilities to source a specified percentage of their electricity from renewable energy sources (wind, solar, etc.). For instance, a rule might require that 50% of electricity come from renewables by 2030. These standards are often more predictable than carbon pricing because they directly specify what must be achieved, though they may be less economically efficient. Subsidies and Incentives Governments also use financial incentives to encourage climate-friendly choices: Tax credits: Provide direct reductions in taxes owed for qualifying investments, such as installing solar panels or purchasing electric vehicles. Grants and loan guarantees: Provide funding or reduce the financial risk for projects like energy-efficiency building upgrades or climate-resilient infrastructure (flood barriers, drought-resistant water systems, etc.). These tools work best for encouraging early adoption of new technologies when market demand is still developing. Adaptation and Resilience Policies While mitigation reduces emissions to prevent future warming, adaptation policies prepare societies for climate impacts that are already unavoidable. These include: Climate planning mandates: Require governments and businesses to develop plans for sea-level rise, extreme heat events, droughts, and flooding. Resilience infrastructure: Uses physical measures like land-use zoning (restricting development in flood-prone areas), upgraded infrastructure standards (stronger buildings, better drainage systems), and disaster-risk financing (insurance programs and emergency funds) to reduce vulnerability. These policies recognize that some degree of climate change is already "locked in" based on past emissions, so adaptation is necessary regardless of mitigation success. Why Climate Change Law Matters Protecting the Most Vulnerable A fundamental objective of climate change law is to protect vulnerable populations—those who have contributed least to the problem but suffer most from climate impacts. This includes: Low-income communities with less capacity to adapt to extreme weather Indigenous peoples whose traditional lands and ways of life are threatened Developing nations with limited resources for climate-resilient infrastructure Future generations who will live with the consequences of today's emissions Climate change law attempts to address this injustice through adaptation funding, commitments to limit warming to levels that allow human adaptation, and accountability mechanisms that pressure high-emitting nations to reduce their impact.
